AgentLink Pty Ltd – Terms and Conditions for Suburb Check & Standard, Featured or Featured+ Agents
1. Acceptance of Terms
By submitting an application to be a featured agent on AgentLink Pty Ltd ("AgentLink"), you agree to the following Terms and Conditions. Your participation is subject to these terms, which may be updated from time to time.
You agree to comply with all applicable data-protection and advertising-platform policies, including Meta’s Lead Ads Terms, when using any data provided by AgentLink.
2. Data Collection and Usage
You acknowledge that AgentLink will collect, store, and process your personal and professional information, including but not limited to your name, contact details, sales statistics, and performance metrics.
Your data may be used for verification purposes, market research, the creation of insights, analyses, and reports regarding agent sales performance data and metrics. You consent to the collection, use, and disclosure of your personal information from API Data, as part of AgentLink’s services to our customers.
AgentLink or Domain do not make any representations or warranties regarding the accuracy, currency, completeness, suitability, or reliability of API Data or any other information accessible via the API Product used in collecting data.
2A. Homeowner Lead Data
AgentLink may provide agents with homeowner contact information (“Lead Data”) collected through AgentLink’s website, Meta Lead Ads, or other marketing channels, solely for the purpose of contacting that homeowner regarding the property enquiry or service they requested.
Agents must use Lead Data only for this stated purpose and must not:
Sell, lease, share, or otherwise distribute Lead Data to any other party;
Add Lead Data to any external marketing, remarketing, or advertising audience (including Meta Custom or Lookalike Audiences);
Combine or enrich Lead Data with any other dataset or CRM outside the purpose of the initial enquiry.
Agents must comply with all applicable privacy and data-protection laws, including the Privacy Act 1988 (Cth) and Meta’s Lead Ads Terms.
If AgentLink determines that an agent has misused Lead Data, AgentLink may suspend or terminate the agent’s subscription immediately without refund.
Agents acknowledge that Lead Data is owned by AgentLink until it is lawfully transferred for the limited purpose above.
3. Public Display and Distribution of Information
You consent to the display of your profile, including your name, contact details, sales history, and performance metrics, on the AgentLink website and in marketing materials.
Your information may be shared with homeowners and third parties associated with AgentLink.
4. Accuracy of Information
You warrant that all information provided to AgentLink is accurate, complete, and up to date.
You agree to notify AgentLink of any material changes to your information.
Providing false or misleading information may result in removal from the platform.
5. Subscriptions
By becoming a Standard, Featured or Premium agent, you agree to pay the applicable subscription fee as set by AgentLink.
Subscription fees are payable in advance and are non-refundable.
AgentLink reserves the right to vary subscription prices, but any changes will only take effect at the end of each subscription term.
5A. Minimum Term and Billing
All Featured and Featured+ 12 Month Subscriptions are for a minimum 12-month term, billed monthly in advance through Stripe or another approved payment processor.
By subscribing, you authorise AgentLink Pty Ltd to automatically debit your nominated payment method each month for the duration of the 12-month term.
Early termination: If you cancel before the end of the 12-month term, the remaining balance for that term becomes immediately payable and may be charged automatically to your stored payment method.
Subscriptions automatically renew for successive months following the 12-month terms unless written notice of non-renewal is received at least 7 days before the current term ends.
Refunds are not provided for partial months or early cancellations.
AgentLink may suspend or terminate access if a payment fails or a chargeback occurs, without releasing the agent from the 12-month commitment.
6. Referral Fee and Commission Discount
A referral fee of 20% + GST applies for any lead provided by AgentLink that results in a successful sale, unless the agent provides sufficient evidence that they had a previous relationship which resulted in an appraisal of the property within the six-month period directly before receiving the lead.
Agents acknowledge that AgentLink may offer a commission discount to new clients, which is deducted from AgentLink’s referral fee and does not impact the agent’s commission earnings.
By accepting these terms, agents agree to honour any such discounts extended to the client by AgentLink, as this forms part of the referral agreement.
Agents must notify AgentLink when they sign an agency agreement for a referred client and provide a copy of the signed agency agreement.
Upon sale, agents must provide AgentLink with a copy of the front page of the signed contract, including the final sale price and commission charged.
Failure to notify AgentLink of a pending referral fee will result in interest penalties being applied. Interest will accrue at 10% per annum, calculated daily on the total referral fee outstanding.
If a different agent within the same office as the referred agent lists and sells the property, a referral fee will still apply unless that agent can demonstrate that they appraised the property prior to the lead being sent by AgentLink. In such cases, no referral fee will be charged.
A referral fee is only payable if the property is listed within 12 months of the lead being sent to the agent. After 12 months, no referral fee will apply.
7. Performance and Quality Standards
AgentLink reserves the right to assess and verify your sales performance, client feedback, and industry reputation.
If you no longer meet the criteria for a featured agent, your listing may be reviewed or revoked at AgentLink’s discretion.
8. Responsibilities of Agents
Agents must inform AgentLink when they sign an agency agreement with a referred client.
Agents must notify AgentLink when a referred property sells, including the final sale price and commission charged.
Agents must provide AgentLink with the agency agreement and the front page of the signed contract of sale as verification.
Agents must handle all Lead Data provided by AgentLink in accordance with Clause 2A and confirm they will not upload or use such data for advertising, audience creation, or unrelated marketing.
9. Termination of Contract
Either party may terminate the agreement with written notice, subject to any outstanding obligations.
If an agent terminates their subscription, they remain liable for any referral fees on sales from AgentLink referrals that occurred before termination. An agent is still liable for the subscription period they initially signed up for, and no refunds for the remainder of the period will be given upon termination of the contract.
AgentLink reserves the right to terminate an agent’s participation for failure to comply with these Terms and Conditions, non-payment, low performance, or misconduct.
10. Liability and Disputes
AgentLink is not liable for any disputes, misrepresentations, or issues arising between agents and homeowners.
You assume full responsibility for all dealings with homeowners and other users of the platform.
11. Modifications to Terms
AgentLink may update these Terms and Conditions at any time without prior notice.
Material updates relating to data-privacy or platform-compliance obligations will be communicated in writing or by email prior to taking effect.
Continued participation as a featured agent constitutes acceptance of any revised terms.
